Three routes for people whose work speaks for itself
All three reward a documented record of achievement. They differ in how high the bar is, whether you need a U.S. employer, and whether the result is a green card or a work visa.
EB-1A Extraordinary ability
For people at the very top of their field in the sciences, arts, education, business or athletics. No employer or job offer is needed, but the evidence bar is the highest of the three.
Read about EB-1AEB-2 NIW National Interest Waiver
For holders of an advanced degree, or people of exceptional ability, whose proposed work has national importance. The job offer and labor certification are waived.
Read about EB-2 NIWO-1A Extraordinary ability visa
A temporary visa for people with sustained acclaim in the sciences, education, business or athletics. It requires a U.S. employer or agent and is often used while building toward EB-1A.

An introduction to licensed attorneys, if you want one
When a profile looks ready for a petition, we can introduce you to independent, licensed U.S. immigration attorneys we work with. The introduction is optional. Any engagement is a separate agreement between you and the attorney, and the attorney alone gives legal advice on your case.
- Optional, never a condition of the session
- You choose whether to engage
- Attorneys are independent of USConsilium

Notes on EB-1A, EB-2 NIW and O-1A
EB-1A or EB-2 NIW? How the two self-petition routes differ
Both let you file for a green card without an employer. The bar, the evidence and the question USCIS asks are not the same.
Read articleThe Dhanasar framework, prong by prong
The National Interest Waiver is decided under a three-part test. Here is what each part asks and where petitions tend to fall short.
Read articleO-1A as a bridge to EB-1A
The O-1A visa and the EB-1A green card use overlapping criteria. For some people, one leads naturally into the other.
Read articleIs USConsilium a law firm?
No. USConsilium LLC is a Chicago-based company, not a law firm. The session is an informational review of your profile against published criteria and is not legal advice. If you want legal advice or representation, we can introduce you to independent licensed attorneys.
What exactly do I get?
A 30-minute one-on-one Zoom session. We read your CV beforehand, then walk through how your record lines up with the EB-1A, EB-2 NIW and O-1A criteria, where it is strong, and what evidence is missing.
Which languages do you offer?
Sessions are held in English only. We do not offer sessions in other languages, even though parts of this website are translated.
What should I prepare?
An up-to-date CV. Include publications and citations, awards, media coverage, patents, peer review or judging, leadership roles and anything else that shows your impact. The more complete it is, the more specific we can be.
Can you guarantee an approval?
No one can guarantee an immigration outcome, and you should be wary of anyone who does. What we offer is a candid read: if your profile is not ready yet, we will say so.
Can I reschedule?
Yes, once, if you email us at least 24 hours before your session.
