Who it usually fits
- Researchers, engineers and physicians with a clear, specific U.S. work plan
- Professionals with a master's degree, or a bachelor's plus five years of progressive experience
- Entrepreneurs whose venture addresses an area of national importance
What the record has to show
First you must qualify for EB-2 through an advanced degree or exceptional ability. The waiver itself is assessed under the three-prong framework set out in Matter of Dhanasar (2016):
- 01Your proposed endeavor has both substantial merit and national importance
- 02You are well positioned to advance that endeavor, based on your education, skills, record of success and plans
- 03On balance, it would benefit the United States to waive the job offer and labor certification requirements
